2 INFORMATION WE COLLECT FROM YOU

2.1 Information you give us

This is information about you that you give us by filling in forms on our site or by corresponding with us by phone, e-mail or otherwise. 5.1.3.1 ensuring the quality of the products and services we provide to you;

5.1.5 to establish, exercise or defend our legal rights for the purposes of legal proceedings.

5.2 If provision of your personal information is a legal or contractual requirement or a requirement necessary to enter into a contract with us, and you choose not to provide it, we may not be able to perform some of the tasks we need to in order to provide certain products or services to you.

6 DISCLOSURE OF YOUR INFORMATION

6.1 You agree that we have the right to share your personal information with:

6.1.1 Any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006.

6.1.2 Selected third parties including:

6.1.2.1 advertisers and advertising networks that require the data to select and serve relevant adverts to you and others. We do not disclose information about identifiable individuals to our advertisers, but we will provide them with aggregate information about our users (for example, we may inform them that 500 men aged under 30 have clicked on their advertisement on any given day). We may also use such aggregate information to help advertisers reach the kind of audience they want to target (for example, women in SW1). We may make use of the personal data we have collected from you to enable us to comply with our advertisers' wishes by displaying their advertisement to that target audience;

6.1.2.2 analytics, web developers and search engine providers that assist us in the improvement and optimisation of our site.

6.1.2.3 our subcontractors or providers of various products and services on our behalf e.g. our delivery partners and other intermediaries, in order to fulfil your orders. Your personal information will always be subject to appropriate protections under contract.

6.1.2.4 our data processors. In common with most organisations, some of our functions using your personal information are outsourced to contractors (for example, Cookiebot who manage our cookies consents or our other software providers). Any processing of personal information by these contractors will only be for these carefully defined purposes, and will be adequately and lawfully protected under contract, including requirements of confidentiality and data security.

6.2 We will disclose your personal information to third parties:

6.2.1 In the event that we sell or buy any business or assets, in which case we will disclose your personal data to the prospective seller or buyer of such business or assets.

6.2.2 If JW Coloursystem Limited, any of its subsidiaries or substantially all of any of their assets are acquired by a third party, in which case personal data held by them about their customers will be one of the transferred assets.

6.2.3 If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use and other agreements; or to protect the rights, property, or safety of JW Coloursystem Limited or its subsidiaries, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

7 WHERE WE STORE YOUR PERSONAL DATA

7.1 All information you provide to us is stored on our secure servers.

7.2 We employ appropriate technical and organisational security measures to help protect your personal data against loss and to guard against access by unauthorised persons. We regularly review our security policies and procedures to ensure our systems are secure and protected.

7.3 Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk.

12 MOBILE MESSAGE SERVICE TERMS AND CONDITIONS

The Josh Wood Colour mobile message service (the "Service") is operated by Josh Wood Colour ltd (“ Josh Wood Colour ”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

Text messages may be sent using an automatic telephone dialling system or other technology. Your consent to receive autodialed marketing text messages is not required as a condition of purchasing any goods or services. If you have opted in, the Service provides updates, alerts, and information (e.g., order updates, account alerts, etc.), promotions, specials, and other marketing offers (e.g., cart reminders) from Josh Wood Colour via text messages through your wireless provider to the mobile number you provided. Message frequency varies. Click the unsubscribe link in any text message to cancel at any time. You'll receive a one-time opt-out confirmation text message. If you have subscribed to other Josh Wood Colour mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change the telephone number we use to operate the Service at any time and will notify you of these changes.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. You agree to maintain accurate, complete, and up-to-date information with us related to your receipt of messages. 

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
